Anyone who intends to carry out activities that are subject to supervision by the Health and Social Care Inspectorate (IVO) under the Patient Safety Act must notify IVO accordingly.
The main purpose of the notification requirement is for IVO to be aware of the services for which it has supervisory responsibility. During an inspection, IVO examines whether the operations being carried out provide care with good quality and safety. In ch. 7 Sections 1-2 of the Patient Safety Act it is specified which activities are covered by IVO's supervision.
Anyone who intends to start a service that falls under the supervision of the IVO must notify this to IVO no later than one month before the service starts.
As of July 1, 2023, IVO may subpoena anyone who has not fulfilled their reporting obligation. The injunction may be combined with a fine, which means that anyone who does not report their business to IVO risks becoming liable for payment.
If an activity is completely or substantially changed or moved, this must be reported to IVO within one month of the implementation.
