Protect your design

A design registration, also known as a pattern protection, protects the design and appearance of your product and prevents others from using the same design. Your design registration is valid for five years from the date of application and you have the option to extend the registration for a maximum of 25 years.

Design or pattern protection applies to the appearance of a product, such as lines, colors and shapes, but not functional details. Protection is primarily obtained through registration, but can sometimes be obtained without. For exclusive rights, the design must be new and distinctive, i.e. clearly different from previously known designs.

Registration gives you an important competitive advantage because you get the exclusive right to use the design. An exclusive right is one of the strongest advantages you can have in a competitive market. If you should end up in a conflict because someone copies your design, it is easier to prove that it is yours.

By informing that you have a design registration, you create greater respect and distance from your competitors and thus gain a larger market share. You also get a good starting point for negotiating financing for development costs and for entering into sales and licensing agreements with others.

Consider whether you need protection

There are times when protection may not be the best solution. If you have created something that has a very short lifespan, you may not need to seek design protection because competitors will not have time to plagiarize you during the short time that the product is in demand.
